OWNER REFERRAL PROGRAM

DETAILS OF PARTICIPATION

Exploria Extras Owner Referral Program (the “Referral Program”) is offered by Club Exploria, LLC, and its affiliates (“Exploria Resorts”), and is subject to the following details of participation:

Participation in the Referral Program: is voluntary, and by participating, you agree to all Referral Program’s details of participation and give Exploria Resorts permission to reference your name and ownership to your Referrals in connection with any offer Exploria Resorts may extend to your Referral.
Participation in this program is limited to active owners of vacation ownership interests (“VOI”) in any Exploria Resort® branded property or in Club Exploria, a multisite timeshare plan (“Owner(s)”), who are in good standing (all maintenance fees, taxes, and loan payments are paid and up to date; Exploria Extras may not be applied retroactively).
Exploria Extras are a benefit to Owners only. Because of this, Embark, Compass, Exploria Market Place members are not eligible to participate until and unless they become Owners.
A maximum of 20 Referrals can be provided by an Owner in a calendar year. In the event of a duplicate Referral, Exploria Extras will be issued to the Owner that first registered the Referral as part of the Referral Program.
Referrals LIST will remain active (contact list) for twenty-four (24) months after being registered with the Referral Program. If the Referral does not purchase a travel package from Exploria Resorts within this time, the Referral will be removed from the Referral Program.
Owners are prohibited from engaging in any advertising or promotions to produce Referrals, including internet advertising or promotions, unless approved by Exploria Resorts. All marketing and sales information or materials, and all sales negotiations concerning Club Exploria or any Exploria Resort shall be provided only by Exploria Resorts and all offering, negotiation and sale of VOIs in Club Exploria shall be conducted exclusively by licensed employees of Exploria Resorts.
Exploria Resorts reserves the right to change these details of participation and any other rule or regulation related to the Referral Program, as well as supplement, terminate or extend the Referral Program, or increase, decrease or otherwise modify the value of Exploria Extras, at any time without notice, in its sole discretion.
Owner must be current with their purchase “money” mortgage payments to Exploria Resorts, and all member fees, and maintenance and real estate tax assessments to the applicable owners’ association in order to be eligible to redeem reward credit.
If an Owner is past due in any payment of the purchase money mortgage with Exploria Resorts, or member fees, or maintenance and real estate tax assessments with the applicable owners association when Exploria Extras are rewarded, Owner agrees that Exploria Resorts will apply the Exploria Extras first to the past due amount. Any remaining Exploria Extras will be awarded to the Owner.
This offer is void where prohibited by law and where state registration and/or licensing requirements have not been met or satisfied. The Referral Program shall be governed by the laws of the State of Florida.
No group travel is permitted.

REGISTRATION OF REFERRALS

All Referrals must pre-register, prior to or upon accepting a vacation package or resort preview being offered by Club Exploria, LLC (“Sponsor”):

Referrals pre-register by providing the following information: first and last name and phone number, email address.
Owner may invite one (1) Referral on a discounted vacation, one per travel dates. Travel dates may not overlap.

QUALIFIED REFERRALS AND ELIGIBILITY

Referrals are eligible only if:

They are at least 30 years of age or older. If married or cohabitating, both spouses and cohabitating partners must attend and complete a 90-minute minimum sales presentation together.
They have a minimum annual household income of $70,000 per year.
They are not already a VOI owner at any Exploria Resort branded property of Club Exploria.
They have not attended a sales presentation at any Exploria Resort branded property in the past.
They meet all other eligibility requirements, including the requirement to attend a sales presentation and creditworthiness, as Exploria Resorts may require from time to time.

OWNER REWARDS

An Owner will only be eligible to receive Exploria Extras for Referrals:
1. who accepted an Exploria Resorts sponsored offer to preview an Exploria Resorts branded property
2. where the owner provided the referrals name and telephone number, email address prior to referral accepting an offer.
Owners will receive a total of one hundred (100) Exploria Extras for each qualified Referral.
For each Referral who purchases a VOI in Club Exploria from Exploria Resorts and closes the purchase (1. pays the full down payment, 2. all contractual rescission periods have passed, and 3. has made at least three (3) consecutive mortgage/promissory note payments, if applicable), an Owner will additionally receive:
1. Three hundred (300) Exploria Extras if the Owner is an Owner in an Exploria Resort and not an owner in Club Exploria;
2. Five hundred (500) Exploria Extras if the Owner is a Bronze level Club Exploria owner;
3. Five hundred fifty (550) Exploria Extras if the Owner is a Silver level Club Exploria owner;
4. Five hundred seventy-five (575) Exploria Extras if the Owner is a Gold level Club Exploria owner; or
5. Six hundred (600) Exploria Extras if the Owner is a Platinum level Club Exploria owner.
Exploria Extras have a value of approximately one dollar ($1.00) per Exploria Extra.

Once an Owner is eligible to redeem Exploria Extras, Owner will be contacted by phone and/or an email please allow four (4) to eight (8) weeks to process Exploria Extras.
Exploria Extras for Referrals who purchase may take up to (6) months for processing.
Exploria Extras expire eighteen (18) months from the date of issue.
Exploria Extras will only be awarded for each Referral after the completion of the Referral’s first sales presentation and after the purchase of the first VOI.
No additional Exploria Extras will be rewarded for attendance at a second or any subsequent sales presentation or on the purchase of any additional VOIs. Exploria Extras will not be awarded on the purchase of any Exploria Marketplace membership or related product.
Taxes relating to Exploria Extras provided to an Owner, if any, are solely the Owner’s responsibility. IMPORTANT TAX INFORMATION: To avoid the IRS backup withholding (currently 28% of Net Income) please complete the IRS Form W-9.

USE OF EXPLORIA EXTRAS

Exploria Extras are only redeemable at Exploria Resort branded properties and may not be combined with any other specialty marketing or ownership discount program.

Exploria Extras are valid for use only with 18 months of the date of issue. Exploria Resorts is not responsible for unused and expired Exploria Extras.

Exploria Extras are non-transferrable.

Exploria Extras may be applied to help pay your purchase money loan with Exploria Resorts.

Exploria Extras may be used to pay your maintenance fees and taxes with the applicable owners’ association.

Exploria Extras may be used to pay Club/Membership Dues to Club Exploria.

Exploria Extras may be applied towards a new VOI purchase or upgrade by an Owner.

Exploria Extras may be issued in the form of check.

Exploria Extras may be used to purchase “Bonus Credits” in Exploria Marketplace.

Exploria Extras may be applied towards “Rental Expos”.
